In anticipation of the effectivity of Department Order No. 221-21 or the Revised Rules and Regulations for the Issuance of Employment to Foreign Nationals, and in pursuit of the DOLE’s mandate to safeguard the interest of Filipino workers through regulating the employment of foreign nationals, the Bureau of Local Employment (BLE) conducted five (5) Online Orientations and Capacity Building Sessions for DOLE Regional Offices (ROs) during the first and second weeks of February 2021.
Over 300 regional representatives participated in the orientations and learning session held on 2-5 and 16 February. Regional Directors, Assistant Regional Directors, Med-Arbiters, TSSD Chiefs, Alien Employment Permit (AEP) Focal Persons, AEP Evaluators, as well as Foreign National Labor Inspectors (FNLIs) were among thos present.
BLE Program Managers discussed pertinent provisions of the revised Guidelines, emphasizing the new provisions on additional and stricter documentary requirements, the cancellation of AEPs, procedures in resolving the denial or revocation of AEPs, the appeals process, accreditation of agents and authorized representatives, prohibited acts and associated penalties, as well as the issuance and validity of certificates for foreign nationals excluded and exempted from securing AEPs.
Following the discussions, participants were given the opportunity to raise their concerns and questions regarding the Guidelines, its impact on current regional operations, as well as emerging special AEP cases that are not yet covered by existing policies.
The Department Order is set to be published in a newspaper of general circulation before the end of the first quarter of 2021, The Bureau is also in the process of developing a Manual of Procedures to assist DOLE ROs in the implementation of the new Guidelines.
